Our firm is dedicated to providing quality legal services in the fields of patents, trademarks, copyrights and trade secrets. Robert C. Kain, Jr. received a Bachelor of Engineering Degree in electrical engineering, a Bachelor of Science Degree in engineering science as well as a Juris Doctor Degree from Vanderbilt University.
He is admitted to practice before the United States Patent and Trademark Office and is admitted to the Bars of Florida, New York, the District of Columbia, the U.S. District Courts for the Southern and the Middle Districts of Florida, the U.S. Court of Appeals for the 3rd and the 11th Circuits and the U.S. Court of Appeals for the Federal Circuit, the sole appellate court for matters relating to patents.
As a longtime member of the Computer-Electronic Law Committee for the AIPLA and the Florida Bar's Computer Law Committee, Mr. Kain's knowledge of the legal protection available for high technology is substantial.
Mr. Kain has confined his practice exclusively to matters involving patents, trademarks, copyrights, computer law and other forms of intellectual property. He has substantial and significant experience in U.S. and international intellectual property matters, and in the highly technical and emerging field of computer law.
Mr. Kain has served for many years as an adjunct professor of law with Nova Southeastern University, Shepard Broad Law Center, providing instruction in the field of patents. Mr. Kain is extensively published in the field of intellectual property.
His publications include Computer Software Patents - Anything Under the Sun Made By Man, Florida Bar Journal, Dec., 1996; Independent Contractors and Computer Crimes -- The Impossible Prosecution?, 1 Boston U.J. Scien. Tech. Law 13, 1995; Should the Federal Circuit Vacate a Judgement of Patent Invalidity merely because the Patent was not Infringed?, ABA's Preview of U.S. Supreme Court Cases, February, 1993; and Commercial Defamation and Trade Disparagement Under Federal Law - The Newly Expanded Scope of Section 43(a) of the Lanham Act, Journal of Proprietary Rights, August, 1989.
We have litigated many patent, trademark, copyright and computer law cases in Florida and throughout the U.S. Mr. Kain has been involved in litigation with Sony, Alcon, Schering-Plough, Caesars' World, Ameritech Corporation, and Cooper Companies. He has testified as an expert witness in patent and copyright cases involving computer programs.
Ellen Kotler, the firm's paralegal, has worked in the intellectual property field for over twenty years. She is highly experienced in the procedures involved in securing U.S and foreign trademarks and filing and processing U.S. patent applications, Patent Cooperation Treaty (PCT) applications and foreign patents throughout the world.
